General trading conditions (AGB)
(To right of revocation see § 7)
§ 1 general
1. If the orderer decides in the context of the order process for a Download of the selected goods to an address indicated by the orderer for eBook, a contract with Werner Modes, Langschmidtsweg 16, comes off 49808 Lingen.
2. To the business relation between the salesman and the orderer excluding the following conditions as per contract apply. Of it the salesman recognizes deviating conditions of the orderer not on, unless he had agreed their validity.
§ 2 conclusion of a contract and resignation

§ 4 prices

§ 5 terms of payment, retention of title
1. The purchase price is immediately net and without departure of discount payment with the order due.
2. The orderer has the choice between in the context of the order procedure offered payment means.
3. The supplied commodity remains up to its complete payment in the property of the salesman. With a Download the assignment of the use license under the reservation of the complete payment of all requirements existing against the orderer takes place.
4. The set-off by the orderer is permissible only if its demand is undisputed or validly determined.
§ 6 conditions for use of eBooks
1. the shop does not provide with the Download one for the orderer eBooks in the format pdf property. The orderer acquires a simple, not transferable right limited revocable before complete payment of the price and only for the use of the offered title for the personal use.
2. Contents eBooks may be changed by the orderer neither contentwise nor editorialally.

§ 7 right of revocation
1. The revocation after the Download is impossible with eBooks.
§ 8 guarantee and adhesion
1. If a lack of the delivery article is present with passage of the risk, the orderer fulfilment thereafter can require either by defect removal or by replacement. If the kind of the fulfilment thereafter selected by the orderer is disproportionate, then the salesman can select those different kind of the fulfilment thereafter in each case. Even if this is disproportionate or is not a salesman not to the fulfilment thereafter in the situation or retards these beyond appropriate periods or fails the fulfilment thereafter in other way, the orderer is entitled after its choice to withdraw from the contract or to require a reduction of the purchase price.
2. An adhesion of the salesman going beyond it is impossible without consideration for the right nature of the validly made requirement, as far as it is based only on more easily negligence.
3. This non-liability does not apply to the case of the injury of a warranty or a contract-substantial obligation as well as with an offence against the product liability law or with the absence of a guaranteed condition. With injury of a contract-substantial obligation the adhesion is however limited to the typically predictable damage.
4. The non-liability in accordance with exp. 2 and the limitation of liability in accordance with exp. 3 do not apply with an injury of the life, the body or the health.
§ 9 data security
1. The orderer authorizes the Shopbetreiber the data entered by the orderer with the registration to process in connection with the business relation in the sense of the data protection acts to store to evaluate and use. The data of the exchange are of it excluded.
2. The orderer is a right to information as well as a right to correction, blockage and deletion of his stored data.
3. The orderer was informed in detail about kind and range of the data storage of personal data under the column “data security” (see also basing the web page).
§ 10 packing
Since over the Shop eBooks as Download are offered, the point with the packing is void.
§ 11 other
It applies German right under exclusion of the UN-purchase quite.
